Pre-application Consultation Notices during COVID-19

Under the Marine Licensing (Pre-application Consultation) (Scotland) Regulations 2013 (“the 2013 PAC Regulations”), there are provisions for a pre-application consultation event to be held at suitably accessible venue.

The Marine Works and Marine Licensing (Miscellaneous Temporary Modifications) (Coronavirus) (Scotland) Regulations 2020 which applied during the coronavirus pandemic will no longer be in force from the end of 30th September 2022.  

These temporary regulations made amendments to the Marine Licensing (Pre-application Consultation) (Scotland) Regulations 2013 – whereby an online pre-application consultation event was required rather than an event at a suitably accessible venue.

The provisions of the Marine Works and Marine Licensing (Miscellaneous Temporary Modifications) (Coronavirus) (Scotland) Regulations 2020 in relation to the Marine Licensing (Pre-application Consultation) (Scotland) Regulations 2013 apply for a period of 6 weeks after the 30th September 2022, therefore online PAC events for relevant projects, will require to be held until 11th November 2022. Following that date PAC events must go back to being in a suitably accessible venue, although applicants may also wish to hold online events in addition to the in-person events
